Probate Law

Decedent Estates

Probate is a legal process in which a court oversees the distribution of assets left by a deceased person. Assets can be anything a person owns which has value, such as real and personal property and cash, for example.

Grieving the loss of a loved one is difficult enough without having to also deal with the intricacies of their estate. Many estates need to go through probate, which is the court process for handling an estate. If someone dies with a will and has named a personal representative (often called an executor) this person will be responsible for administering the estate. If someone dies without a will or did not appoint a personal representative in the will, the probate court will appoint one.

It is essential to work with an experienced attorney to protect your interests and help you navigate the estate administration process.

Guardianships and Conservatorships

Individuals who are unable to make financial, medical and other important decisions in their own best interest may be eligible for a general or limited conservatorship. In this case a trusted person is responsible for some or all of their financial and other important life decisions. I can be hired to assist with preparing the documents needed to demonstrate that there are no legal alternatives that ensure the well-being of a person and their assets. The probate court’s reporting and filing requirements regarding conservatorships can be overwhelming. I am able to make that process less of a burden on conservators.

Contact me for an initial consultation so we can see if a guardianship or conservatorship is in the best interest of your loved one.
